Terms of Use

These terms govern access to Capsula, including its mobile app, website, consumable keys and backend key-custody service.

1. Operator and agreement

These Terms are an agreement between you and Lesound App SAS, established in Colombia at CR 48 46 54, Itagüí, Colombia. Contact: laitelabs@gmail.com.

By creating an account, purchasing a key or using Capsula, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. Mandatory consumer rights remain unaffected.

2. Eligibility and accounts

You must be at least 18. Capsula is not directed at children. By creating an account you represent that you meet this age.

You sign in through Google or Apple. You are responsible for keeping that account secure, providing accurate information and notifying support of suspected unauthorized access. You may not sell, transfer or share an account in a way that defeats store, security or ownership controls.

3. What Capsula provides

Capsula lets you assemble content locally, encrypt it into a capsule archive, keep that encrypted archive on your device or in storage you choose, and deposit the capsule data-encryption key with the backend in wrapped form.

The backend stores capsule identifiers, purchase/credit records and cryptographic custody data. It does not store your capsule archive or its photos, videos, audio, notes, names, descriptions or filenames.

Features may be pre-release, unavailable on some platforms or changed before general availability. Store descriptions and in-app disclosures applicable at the time of use form part of the service description, but cannot remove mandatory rights.

4. Unlock conditions and time-lock limitations

A custodied key is released only after the server determines that the scheduled unlock time has arrived and the caller presents the correct unlock secret. Both conditions are required.

This is a server-enforced time gate, not a cryptographic time-lock. It depends on the backend, database, server clock, authentication and Google Cloud KMS. Capsula does not guarantee release at an exact second, uninterrupted availability or protection against every compromise of the service infrastructure.

5. Your archive and secret are your responsibility

The archive and secret are both required. Losing either may make the capsule permanently inaccessible even if the other survives.

  • Keep the encrypted capsule archive and any backups in storage you control. Capsula cannot restore a file it never receives.
  • Keep the unlock secret private and available until opening. Capsula stores only a one-way hash and cannot recover or resend the secret.
  • Confirm that the archive is safely stored before deleting local source material. Device loss, storage-provider failure or deletion may permanently destroy the only archive copy.

6. Consumable keys

A “key” is a consumable in-app credit used to seal one capsule and place its encryption key in custody. Keys are one-time products, not subscriptions, and do not renew automatically.

An unused key has no scheduled expiration while your account and the service remain available. It is consumed when the backend accepts custody for a capsule. A consumed key cannot be reused. See the Purchases & Refunds Policy for store processing and refunds.

7. Your content and acceptable use

You retain your rights in content you place in a capsule. Because capsule content remains local, you do not grant Capsula a license to host that content. You authorize only the processing of account, purchase and key-custody data needed to provide the service.

You may not use Capsula to violate law or another person’s rights, distribute malware, attack or probe the service, bypass authentication, rate limits, payment, ownership, unlock-time or secret controls, or interfere with other users. You are responsible for having the right to use content you place in your archive.

8. Third-party services

Google, Apple, storage providers, app stores and other providers have their own terms and privacy practices. Store terms govern payment processing and may govern refunds. Capsula is not responsible for a third-party service outside its control, but this does not limit liability that applicable law does not allow us to exclude.

9. Availability and changes

We may maintain, modify, suspend or discontinue features for security, legal, technical or business reasons. Where required, we will give reasonable notice and provide remedies required by law.

No statement that a capsule or key is “forever” guarantees perpetual operation of Capsula, a device, a storage provider or any third-party infrastructure. Statutory obligations for digital services continue to apply.

10. Suspension, termination and deletion

We may restrict an account where reasonably necessary to address fraud, security threats, unlawful use or material breach, with notice and an opportunity to challenge the action where required.

You may request deletion through the in-app account-deletion option, or by email to laitelabs@gmail.com. Deletion may remove unused credits. Wrapped custodied keys are deleted when the account is deleted, which permanently prevents the corresponding capsules from being opened.

11. Capsula intellectual property

Capsula, its software, branding, visual design and service materials are owned by the operator or its licensors. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable and revocable right to use the service for its intended purpose. You may not copy, resell or reverse engineer it except where law expressly permits.

12. Warranties and consumer rights

Capsula will provide the service with reasonable care and in conformity with applicable mandatory digital-content and consumer law. Except for rights and warranties that cannot be excluded, the service is provided on an “as available” basis and we do not promise uninterrupted operation or that every device, cloud provider or future platform will remain compatible.

Nothing in these Terms excludes rights to repair, replacement, price reduction, termination, refund or other remedies that applicable law grants you.

13. Liability

To the maximum extent permitted by law, any contractual liability cap is the amount paid to Capsula for the keys that give rise to the claim. This cap must not exclude liability that applicable law does not allow to be limited.

Nothing limits liability for fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, violation of data-protection law, or mandatory consumer rights. Your responsibility to preserve the archive and secret does not excuse a failure by Capsula to perform obligations imposed by law.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia, and disputes are submitted to the courts of Itagüí, Colombia. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law of your habitual residence.

Before filing a claim, contact laitelabs@gmail.com so we can try to resolve it informally. You may also use any consumer authority or dispute process available to you.

15. Changes and contact

We may update these Terms prospectively. Material changes should be notified before taking effect where required. Continued use cannot waive rights that require express consent.
